Property Owner Agreement including Release and Waiver Example
This sample Property Owner Agreement is designed for churches, ministries, and disaster response organizations providing volunteer services on privately owned property following a disaster or during community outreach.
The agreement establishes the property owner’s authorization for the organization and its volunteers to perform services such as debris and brush removal, removal of downed trees, removal of damaged personal property, and other real property repair or improvement activities.
The document includes provisions addressing assumption of risk, release and waiver of liability, property and liability insurance responsibilities, photography and media consent, and additional agreement terms. It also includes provisions for identifying other individuals or entities with an ownership or legal interest in the property and indemnification related to third-party property claims.
For disaster response use, the document also contains a separate authorization allowing relevant information to be released to FEMA and other third-party agencies involved in disaster response when necessary to help determine or secure assistance.
This resource can serve as a starting point for organizations developing their own property-owner authorization and waiver process. Because liability, waiver, indemnification, arbitration, and other requirements may vary by state and organization, the document should be reviewed by the organization’s legal counsel and insurance provider before use.
